THE SHORT VERSION
- DesignDog is a monthly platform fee plus pay-as-you-go AI credits, and every design shows what it cost.
- You own your brand assets and the designs you create.
- Only upload what you have the right to use, and check designs before you publish them.
- Cancel anytime. Your plan keeps running to the end of the period you've paid for.
01
Agreeing to these terms
These Terms of Service ("Terms") are an agreement between you and Kimp ("Kimp", "we", "us"). They cover your use of DesignDog, including the website, apps and related services.
By creating an account or using DesignDog, you agree to these Terms and to our Privacy Policy. If you use DesignDog for an organisation, you confirm you can accept these Terms for it, and "you" includes that organisation.
02
Your account
- You must be 18 or older, or the age of majority where you live.
- Give us accurate information and keep it up to date.
- We sign you in with one-time email links or single sign-on, so keep your email account secure. You're responsible for activity under your account.
- Tell us straight away if you think someone has used your account without permission.
03
The service
DesignDog turns briefs you speak or type into designs that follow your Brand Memory. We're always improving it, so features may change.
Features marked as coming soon or beta, such as video design, may be unavailable, incomplete or changed before release. We aim to keep DesignDog available around the clock, but we can't promise it will be uninterrupted or error-free.
04
Plans, credits and billing
- The DesignDog platform is billed monthly in advance at the price shown when you subscribe (currently $49 per month), plus any applicable taxes.
- Designs are paid for with AI credits you buy in advance. The cost of each design depends on its size and quality, and is shown every time.
- Your subscription renews automatically each month until you cancel. You can cancel anytime and keep access until the end of the period you've paid for.
- Fees and credits are non-refundable, except where the law says otherwise. Credits have no cash value and can't be transferred.
- If we change our prices, we'll tell you in advance, and the change applies from your next billing period.
05
Your content
You keep all rights to what you bring to DesignDog: logos, fonts, images, brand books, briefs and voice recordings ("Your Content").
You give Kimp a worldwide, non-exclusive licence to host, copy, process and display Your Content, only to provide DesignDog to you and to share it with our service providers for that purpose.
You confirm you have the rights you need to upload Your Content, including licences for paid fonts and stock images, and that using it with DesignDog won't infringe anyone else's rights.
06
Designs you create
As between you and Kimp, you own the designs DesignDog generates for you, and you can use them for any lawful purpose, including commercial use.
Designs are generated by AI, so similar results may be created for other people, and we can't promise a design is unique or free from third-party rights. Check every design before you publish it, especially names, prices, claims and anything regulated.
07
Acceptable use
Don't use DesignDog to:
- break the law, or help anyone else do so
- infringe trademarks, copyright or other rights, or pass yourself off as a brand you don't represent
- create deceptive, defamatory, hateful, violent or sexually explicit content, or anything that exploits minors
- run misleading ads or make claims you can't back up
- upload malware, probe or overload our systems, or get around usage limits or credit charges
- copy, resell or reverse engineer DesignDog, or use it to build a competing product
- scrape the service or access it by automated means, except through features we provide
08
Our property
DesignDog, including its software, design system, illustrations and the DesignDog name and logo, belongs to Kimp and its licensors. These Terms don't give you any rights in it beyond using DesignDog as described here.
If you send us feedback or ideas, we can use them without any obligation to you.
09
Third-party services
DesignDog relies on third parties for things like single sign-on, payments and AI models. When you use a third-party service, for example to sign in, that provider's own terms may also apply.
10
Suspension and closing your account
You can close your account at any time. We may suspend or close your account if you break these Terms or don't pay, or where we must to comply with the law or protect DesignDog and its users.
Where we reasonably can, we'll tell you first and give you a chance to download your designs. Terms that by their nature should continue after your account closes will continue.
11
Disclaimers
DesignDog is provided "as is" and "as available". To the fullest extent the law allows, Kimp disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
Nothing in these Terms limits rights you have under consumer law that can't be excluded.
12
Limitation of liability
To the fullest extent the law allows, Kimp isn't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill.
Kimp's total liability for any claim relating to DesignDog is limited to the amount you paid us in the 12 months before the claim arose.
13
Indemnity
If someone brings a claim against Kimp because of Your Content, or because you used DesignDog in breach of these Terms, you'll cover the reasonable costs of that claim, including legal fees.
14
Changes to these terms
We may update these Terms as DesignDog evolves. If a change is material, we'll tell you by email or in the app before it takes effect. If you keep using DesignDog after that, you accept the updated Terms.
15
Governing law and disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules. Disputes will be resolved in the courts of Ontario, unless your local consumer law gives you the right to bring proceedings where you live.
Before filing a claim, please contact us so we can try to resolve it informally.
